Maybe you had a medical emergency or you lost your job or hours at work. You work more than one job, but no matter what, you just don’t have enough money to pay all your debts. You’re worried about losing your home and not being able to afford your car. Your credit score is in the tank.

What do you do? The people at the bank and creditors may have told you to liquidate your IRA and other retirement accounts to pay off the debts because … everyone believes bankruptcy is taboo.

Bankruptcy is legal. It is made to help and it will put you on the path to financial and emotional recovery. Don’t liquidate your retirement accounts! Come see me first!

What Are Chapter 7 And Chapter 13 Bankruptcy?

Individuals, and some businesses, can choose between a Chapter 7 and Chapter 13 bankruptcy.

  • A Chapter 7, depending on your gross income and the number of dependents in your home, allows you to completely walk away from some or all of your debts and/or reaffirm others so that you can keep assets like your home and car.
  • Chapter 13 allows individuals, who have certain levels of income, to reaffirm some debts, like those for a home, car or business asset, pay debts they are behind on and reduce the amounts  owed to others, such as personal loans, credit cards and the like, and to make those arrearages and reduced amounts over periods of time as set by law.
